General Auction Terms & Rules
The following rules pertain to and govern all auction activities of the Canadian Cancer Society's Sixth Annual Diamond Ball, 2002. Please be sure to read them carefully before bidding.
- The Sixth Annual Diamond Ball and the Canadian Cancer Society (CCS) make every effort to properly and accurately catalogue and describe all auction items. All items are sold "as is" and should be considered non-exchangeable, unless otherwise indicated. This Sixth Annual Diamond Ball and the CCS neither warrants nor represents, and shall in no event be responsible for the correctness of description, genuineness, authorship, provenance or condition of the property. No statement contained in the website or elsewhere shall be deemed to be a warranty, representation, or assumption of liability.
- All auction items and services must be used before April 20, 2003, unless otherwise specified. All items and services have no cash value.
- The Sixth Annual Diamond Ball/CCS reserves the right to withdraw any item from any auction prior to the call for bids.
- The Closing time for the On Line Silent Auction is 8:00pm PST on Saturday, April 20, 2002. .
- The One Bid Silent Auction will close on the website at 5:00pm PST on Friday, April 19, 2002. The highest bid at this point will be sealed and will become a secret bid on the item during the Diamond Ball from 6:00pm - 8:00pm on Saturday, April 20, 2002. All bids from 6:00pm until closing will be secret bids. The highest bid at the closing time of 8:00pm will be considered the winning bid.
- All One Bid Silent Auction bids will remain sealed until the close of the One Bid Silent Auction at 8:00 pm.
- In the event of two or more bidders submitting an identical bid in the One Bid Silent Auction on the same item (and that bid being the highest bid), the Sixth Annual Diamond Ball/CCS will conduct a draw and the name drawn shall be declared the succe that item.
- Some or all auction items will have a set starting minimum bid. Please be sure to check each bid sheet for this information. Any bid that is below the set starting minimum bid will be disqualified.
- Each Silent Auction bid must increase by the minimum increment shown on the bid sheet. Silent Auction bids not increased by the minimum increment will be ruled invalid.
- The auction bid posted on the website constitutes a legal contract to purchase. The top bidder will be awarded the right to buy the item at the price acknowledged or written, providing auction rules have been followed.
- Notwithstanding the above, in the event of a dispute involving any auction item, other than Live Auction items, the decision of the Sixth Annual Diamond Ball/CCS will be final.
- If, for any reason the highest bid on any item is invalid, the second highest bid will be considered the successful bid.
- All sales are final. There is no exchange, refund or replacement of items including gift certificates by the Sixth Annual Diamond Ball, the CCS or the donor, unless otherwise specified.
- Sales tax is applicable on certain items.
- Winning bidders will be contacted by Wednesday, April 24 to arrange payment and delivery/pick up of their items. Payment for any auction item by the successful purchasers must be made in full before the item is picked up or sent to the purchaser.
- Payment must be made by cash, personal cheque, Visa, MasterCard.
- Title to sold merchandise will remain with the Canadian Cancer Society until the credit card, or cheque payment has been cleared for the item in question.
- Auction items including gift certificates can be picked up at the Canadian Cancer Society Diamond Ball office or may be mailed to the successful purchaser. Shipping and handling charges will be added to the purchaser's bill.
- The successful bidder, upon taking possession of an auction item, will be responsible for the security of it from that point onwards.
